2008年より商事訴訟および紛争解決に携わり、さまざまな業種のクライアントにサービスを提供している。商業・契約紛争、規制・競争問題に関して日常的にアドバイスを行っている。 Hight Court（連邦最高裁判所）、Supreme Court （連邦裁判所）、Federal Court and Family Court（連邦家庭裁判所）においてその豊富な訴訟弁護士の経験を活かし、大規模かつ複雑な訴訟を手がけている。また、その活動範囲はDistrict Court（地方裁判所）やLocal Court（簡易裁判所） まで及ぶ。 取り扱い分野は、詐欺、偽造、契約違反、欺瞞行為、不法行為、損害賠償責任、知的財産侵害、取締役責任、独占禁止法等、広範囲で様々である。 H＆H Lawyersの一員になる前は、大手法律事務所の訴訟部門に15年以上在籍し、社会的に注目度の高い企業紛争にも多数携わった。

主な 職歴・実績

  • 米国のNASDAQ上場企業（医療治療システムの開発メーカー）の代理人として、オーストラリアのレーザー美容クリニックから提訴された、欺瞞的な行為に関する損害賠償請求事件を担当。

  • 大手国際海運会社の代理人として、ACCC（公正取引委員会）および他の国際競争規則当局が実施した、国際的カルテル行為の疑惑に関する調査に関与。

  • 個人および企業による欺瞞的行為に関するACCCの訴追を支援。

  • 映画・テレビスタジオのグループから提訴された著作権侵害訴訟において、インターネット・サービス・プロバイダーの代理人を務めた。

  • 登録意匠の侵害が疑われる訴訟において、オーストラリアのファッションブランドの代理人を務めた。　

  • 外国為替取引およびオーストラリア銀行スワップレートの不正行為に関する、ASIC（オーストラリア証券投資委員会）による調査において複数の銀行の代理人を務めた。

  • ASICによる、違法金融商品アドバイス調査において、大手不動産グループへ助言し、その後の最高裁判所での裁判において、代理人を務めた。

  • 虚偽、誤解を招く、不誠実な行為および連邦政府に対する詐欺に関連し、行われたACCCによる調査およびその後の連邦裁判所における訴訟で、オーストラリアの大手専門学校の代理人を務めた。

  • 過失の疑いのあるアドバイスに関する訴訟において、さまざまな企業の代理人を務めた。

  • 銀行および金融機関の代理人として、債権回収、担保権の執行、詐欺や偽造、不履行、さらには誤解を招く行為や欺瞞的、不当な行為に関する問題に対応。

  • 家庭裁判所の訴訟において、会社の大株主であり取締役である夫に対して、妻が求めた、会社の利益が脅かされる命令に関し、会社側の代理人を務めた。

  • オーストラリアの大手エンジニアリング会社を代理人となり、国際的なシリアルメーカー向けの小麦サイロの設計および建設における欠陥に関する紛争を担当。

  • ICAC（Independent Commission Against Corruption）のOperation Credo and Operation Spicerに関与した複数の個人の代理人を務めた。

We welcome Timothy Chan as partner. Timothy is a highly experienced litigation lawyer with a demonstrated history in largescale and complex litigation matters. Prior to joining H & H, he practised for over 15 years at a national law firm, where he was involved in numerous significant landmark disputes. Timothy acts for a broad range of private and corporate clients across many different industries in various jurisdictions representing and advising them on commercial and contract disputes as well as regulatory and competition matters. We are excited to have Timothy on board to continue to grow our dispute resolution and commercial litigation practices.
